Wellness Mobile Application Terms and Conditions

1. Acceptance of Terms
By using the FOMEMA Pharmaceuticals Wellness Mobile Application (“the App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you are prohibited from using or accessing the App.
2. Use of the App
You have read, understood, and agree to this Terms. You must be at least 18 years old to use the App. You agree to use the App only for lawful purposes and in compliance with all applicable laws and regulations. You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account.
You agree not to use the App in any way that could damage, disable, overburden, or impair the App or interfere with any other party’s use of the App.
The App reserves the right to suspend or terminate accounts that violate these terms, including accounts created by users below the required age. Some features of the App may have additional terms, which will be provided in connection with those features. These additional terms are incorporated into this Terms by reference. In case of conflict, the additional terms will prevail for those specific features or services.
3. Content
The App may contain health and wellness information, including articles, videos, and other materials. This content is for informational purposes only and is not intended as a substitute for professional medical advice, diagnosis, or treatment. You should always consult with a qualified healthcare professional regarding any health concerns or before making any decisions related to your health or treatment.
4. Intellectual Property
The App and its content, including text, graphics, logos, images, and software, are protected by intellectual property laws and are the property of FOMEMA Pharmaceuticals or its licensors. You may not copy, reproduce, distribute, modify, or create derivative works of the App or its content without our prior written consent.
5. Disclaimer of Warranties
You expressly acknowledge and agree that your use of the App, any content or information contained therein, and any services offered is at your sole risk.
The App is provided “as is” and “as available” basis and without warranties of any kind, either express or implied.
We do not warrant that the App will be uninterrupted or error-free, that defects will be corrected, or that the App or the server that makes it available are free of viruses or other harmful components.
6. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages.
As a user of the App, you agree to indemnify, defend, and hold harmless FPSB and its affiliates, officers, agents, employees, partners, and licensors from and against any claims, demands, liabilities, damages, losses, and expenses.
7. Termination
We may terminate your access to the App at any time for any reason without notice.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Malaysia.
9. Changes to Terms
We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on the App or through other means. Changes will be effective immediately upon posting. Your continued use after such changes constitutes acceptance of the new terms.
10. Acknowledgement and Acceptance
Your continued use of the App signifies your acceptance of this Terms and any modifications. This Agreement can only be amended as outlined in this section.
